Pertaining to notification dated 11.6.1996 whereunder 173 bigha and 12 biswa of agricultural land in village Ghevra was acquired, the learned Land Acquisition Collector determined compensation at the uniform rate of 1,86,500/- per bigha and awarded the same to the appellants in respect to their acquired land which comprised Khasra No.68/2/2 (1-12) and 9 (4-16).
The learned Reference Court has dismissed the reference by maintaining the award amount.
Issue has been settled by Division Bench of this Court in its decision dated 19.12.2008, lead matter being LA.App.No.193/2006 Pratap Singh (Since deceased) Through LRs Vs. UOI & Ors. For the notification in question, with respect to LA.APP. 15812009 page 1 of 2

lands in Category 'A' fair market value determined is 2,35,815/-per bigha and for Category '' lands fair market value determined is 1,90,156/- per bighá.
Other statutory benefits on the enhanced compensation have also been directed to be paid.
Instant appeal stands disposed of decreeing that the appellant would be entitled to enhanced compensation @ 2,35,815/- per bigha if their lands are in Category 'A' or 1,90,156/- per bigha if the subject lands are in Category 'B'. Statutory benefits on the enhanced compensation as interpreted by the Supreme Court in the decisipn reported as 93 (2001) DLT 569 [Sunder Vs. UOI ][shall also be pad. ]
Proportionate costs as well.
