This petition under Section 482 Cr.P.C has been preferred by the petitioner for quashing of FI R No.153 of 2010 dated 22[nd ]November 2010 registered with police station Bhalswa Dairy under Section 304A IPC and the consequential proceedings arising therefrom.
The deceased died while working at his workplace and doing the work of loading and unloading of goods and case of negligence was registered against the petitioner. loading and unloading of goods and case of negligence was registered against the petitioner.
The petitioner has agreed to pay amount of Rs.3 lac to the deceased's father and wife (respondents no.2 and 3 being identified by their counsel) for father and wife (respondents no.2 and 3 being identified by their counsel) for compromising the matter. Out of Rs.3 lac, Rs.1 ,90,0001- has been paid today and Rs.10,0001- was paid earlier by the petitioner. The remaining amount of Rs.1 lac shall be paid by the petitioner to the father and wife of the deceased within one week from today. Out of Rs.2 lac, Rs.1 lac shall be handed over to the wife of the deceasedSmt. Sanjan Devi i.e. respondent no.3 herein. In view of compromise arrived at between the parties, this petition is allowed and FI R No.153 of 2010 shall be paid by the petitioner to the father and wife of the deceased within one week from today. Out of Rs.2 lac, Rs.1 lac shall be handed over to the wife of the deceasedSmt. Sanjan Devi i.e. respondent no.3 herein. In view of compromise arrived at between the parties, this petition is allowed and FI R No.153 of 2010
dated 22[nd ]November 2010 registered with police station Bhalswa Dairy under Section 304A IPC and the consequential proceedings arising therefrom are hereby quashed.
It shall be the responsibility of the counsel for the petitioner to ensure that the amount is handed over in his presence to the wife of the deceased and receipt thereof is filed on record. In case of non-compliance of thi order become non est and the present FIR shall stand.
