By this application the appellant seeks to withdrawthe present appeal.

Mr. Anil Aggarwal, counsel for the appellant states

that the marriage between the parties has already beendissolved by decree of divorce by the court of Mr. KamleshKumar ADJ, Rohini Courts, Delhi vide order dated 6.8.20tLunder Section 138(2) of the Hindu Marriage Act. Counselfurther submits that the appellant has already taken steps toseek quashing of the FIR No. 77612004 which was gotregistered by the respondent under Section 406/49BN34IPC.For the reasons stated in the application, the appellant ispermitted to withdraw the present appeal.

Application is allowed.

In this present appeal the appellant has sought to

challenge the judgment and decree dated L0.8.200T passedby the learned ADJ, Rohini Court, Delhi, whereby the petitionfiled by the appellant under Section Lz(L) (c) of the HinduMarriage Act was dismissed. Since the marriage hasalready been dissolved by the decree of divorce under Section138(2) of the Hindu Marriage Act, therefore the appellant hasapproached this court to withdraw the present appeal.

The appeal is accordingly dismissed as withdrawn.
