The present are the petitions under Article 226 of the Constitution ofIndia read with Section 482 of the Code of Criminal Procedure, 1973seeking quashing of cross FIRs, one FIR bearing No. 348/2015 under
Sections308/323/506/34 IPG registeredat Police Station-Bindapur,Delhi
and the otherFIR bearingno. 359/2015under Sections354/308/341/506/34
IPG registeredat PoliceStation-Bindapur,Delhiandtheproceedingsarisingtherefrom.
The parties along with their counsel have been heard and both the
petitionsare beingdisposedofby this commonorder.
The FIRs wereas aof subject registered consequence squabbling
betweentwo groups ofpeopleboth claimingownershipto aparcelof landsituatedinVillageBindapur,Delhi.
It is an admittedpositionthat as consequenceofaltercationbetween
two groupsand the blowsthatwere exchangedby and betweenthem, simpleinjurieswerecausedto the complainantsin boththesubjectFIRs.
Gounselfor the partiesstatethat with the interventionofrelativesand
residents of Bindapur Village, the parties have amicably resolved theirdispute that led to the registrationof the subject FIRs. It is, therefore,prayedthatthe subjectFIRsmay be set asideand quashed.
It is further admitted by the parties that the subject land has been
acquiredand is in the possessionofDelhiDevelopmentAuthorityalthoughtofor the saidareproceedingsrelating compensation acquisition pendingbefore the Gollector concerned.
In viewofthe foregoing,the complainantsin the subjectFIRs namely
Asghari Devi and Lakshmi Devi who are present in Gourt and have beenidentifiedby theirrespectivecounselas well as the InvestigatingOfficerinthe subject FIRs namely SI Amit Kumar, Police Station Bindapur,Delhistatein unisonthatin viewofthe amicableresolutionofall theiroutstandingdisputes,they are no longerkeen to proceedwith the subjectFIRs and the
proceedings arising therefrom.
In view of the foregoing, no useful purpose will be served byproceeding with the subject FIRs.
Resultantly, FIR No. 348/2015 under Sections 308/323/506/34 IPGregisteredat Police Station-Bindapur,Delhi and the other FIR bearingno.359/2015 under Sections 354/308/341/506/34IPG registered at PoliceStation-Bindapur,Delhi and the proceedingsarisingtherefromare herebyset aside and quashed qua all the petitioners subject to each one of themdepositinga sumof Rs.5,000/-withthe Victims' GompensationFundwithina period of two weeks from today. copy of the receipt thereof shall befurnished to the Investigating Officer in the subject FIR namely SI AmitKumar, Police Station- Bindapur, Delhi.
With the above said directions,the present writ petitions are allowedand disposed of accordingly.
All pending applicationsalso stand disposed of./
