ORDER%18.02.20151.CRL.A.291/2014hasbeenfiledbythevictim/injuredandCRL.A.1612/2014has been filed by the State. Both these appeals arebeing disposed of by common order as it is informedby counsel forthe parties that the parties(injuredand the accusedpersons)havearrived at an amicable settlement.
2.As per the case of the prosecutiona man, namely,RajenderSinghSignature Not VerifiedDigitally Signed(appellantin CRL.A. 291/2014),was shot at JantaFlatsin frontofBy:AMULYA
GTBHospital,nearMasjid.Theinjured,RajenderSingh,is thehusbandof the sisterof the accusedpersons,Sh.BalakRam andSh.Sanjay(respondentsno.2and3inCRL.A.291/2014andrespondentsno.land2inCRL.A.1612/2014).DDNo.llAwasrecordedat Police StationDilshad Garden pursuant to which an FIRwas lodgedunder Section307 of the IndianPenalCode read withSection27of TheArmsAct. Theprosecutionhasexamined16witnesses.Statementofrespondentsno.2and3hereinwererecordedunder Section313 of the Code of CriminalProcedure.Thetrial Court reacheda conclusionthat the prosecutionhas failed toprove its case under Section307 of the IndianPenal Code beyondreasonabledoubt.ThetrialCourt,however,opinedthattheprosecutionhad been able to prove its case under Section 324 readwith Section34 of the IndianPenalCode.Respondentno.2,BalakRam,washeldguiltyfor theoffencepunishableunderSections324/34IPC read with Section27 of the Arms Act.3.Learnedcounselfor the partiessubmit thathavingregardto thefacts that the parties are close relationsand with the interventionofeldersandfriendsthepartieshaveenteredintoanamicablesettlementwitheachotherandrespondentsno.2and3havetenderedan unconditionalapology to the victim,Mr.RajenderSingh,the presentappealsmay be deposedof on the followingagreedterms:
(i)respondentsno.2 and 3 have tenderedan unqualifiedapology to the victim, Mr.RajenderSingh.apology to the victim, Mr.RajenderSingh.
(ii)To put quietus to the matter, the parties to the presentmatters shall not press or instituteany furtherlitigationin any Court of law.matters shall not press or instituteany furtherlitigationin any Court of law.
(iii)Respondentsno.2and3wouldnotharassorharmMr.RajenderSingh(appellantin CrI.A.No.291/2014)orhisfamilymembers,in anymannerwhatsoever,infuture.Mr.RajenderSingh(appellantin CrI.A.No.291/2014)orhisfamilymembers,in anymannerwhatsoever,infuture.(iv)Respondentsno.2 and 3 havepaid sum of Rs.4.50lakhstoMr.RajenderSingh(appellantinCrI.A.No.291/2014)inCourttowardsfullandfinalsettlementof all disputes and differences,which amountis duly acknowledgedby the appellant.lakhstoMr.RajenderSingh(appellantinCrI.A.No.291/2014)inCourttowardsfullandfinalsettlementof all disputes and differences,which amountis duly acknowledgedby the appellant.
