The present petitions have been filed by the petitioners under Section482 Cr.P.C. for quashing of proceedings emanating from FIR No.624/2000,under Sections 323/341/34 IPG and FIR No.624/2000, under Sections323/341/34 IPG, registered at Police Station Model Town, Delhi andcomplaint case bearing No.147/1/2000filed by the respondent No.2 underSections395/452/506/34IPG on the basisof the settlementarrivedatbetween the parties.
During the pendency of the proceedings, the petitioners andrespondent No.2 in their respective cases have settled their disputesamicably by virtue of Gompromise/Acknowledgement-cum-Undertakingdated 25'*^ October,2014. The same is placedon recordwhich is signedbythe parties. Parties shall be bound by the terms and conditions mentioned insame.They are also present in Gourt and are duly identifiedby theircounsel. have confirmedthe said settlement. have norespective TheyTheyobjectionif boththeFIRs and complaintcasebe quashed.
In view of the averments made in the petitions as well as thesettlementarrivedat betweenthe parties,the proceedingsarising from theFIR No.624/2000,under Sections 323/341/34IPG and FIR No.624/2000,under Sections323/341/34IPG, registeredat Police StationModel Town,Delhi and complaintcase bearing No.147/1/2000filed by the respondentNo.2 under Sections 395/452/506/34IPG are quashed, subject to thefollowing conditions:
(i)Mr.MadanKumarshalldepositRs.1lac (RupeesOne Lac) withthe PrimeMinisterReliefFund withinsix weeks. The originalreceipt of depositing the cost shall be filed by him in theRegistrywithin eightweeks and copy thereof be also handedoverto the10. In case the receiptis not filed by the petitionerwithin the stipulated period, the 10 shall inform the learnedAPP for the State who shallinformthe Gourtfor furtherdirections.the PrimeMinisterReliefFund withinsix weeks. The originalreceipt of depositing the cost shall be filed by him in theRegistrywithin eightweeks and copy thereof be also handedoverto the10. In case the receiptis not filed by the petitionerwithin the stipulated period, the 10 shall inform the learnedAPP for the State who shallinformthe Gourtfor furtherdirections.
(ii)Mr.Madan Kumar shall furnish his personal bond of goodconduct for period of five years. He shall additionallyundertakethereinthatduringthisperiod,he shallmaintaingoodbehaviour and character and shall not indulge in any suchactivitiesas haveFIR. The same beenmentionedin the subjectconduct for period of five years.
