The petitioner seeks direction that discharge order should be issued by the Indian Air Force to enable him to join the Central Reserve Police Force (CRPF) as an Assistant Commandant. The petitioner is currently serving as Corporal in the Indian Air Force, where he has been working since 2006. He was selected to the post of Assistant Commandant after he was issued No Objection Certificate (NOC) by Indian Air Force to attend the interview for the post.

It is stated on behalf of the respondents, especially the Indian Air Force that the process of issuing discharge order is likely to take two weeks and that although the concerned unit has recommended this course, the final order by the competent authority is awaited. The CRPF, on the

other hand, submits that in these circumstances it may be appropriate for the Court to ensure that one post is kept vacant. The CRPF does not dispute that the petitioner was allotted the post in the Central Armed Police Force Recruitment, 2013 which the petitioner participated in.

In view of these developments, the Indian Air Force is hereby directed to process the petitioner’s request for discharge at the earliest and in any case may ensure that the orders in that regard are issued within four weeks from today. The CRPF, in the meanwhile, shall reserve one post to be filled up in the event the discharge order is issued in terms of the directions of this court and grant the petitioner further joining time of at least 8 weeks from today.

The writ petition is disposed of in the above terms.
