1.Vide judgment dated 31[st]August, 2015 in W.P.(C)11487/2009, theCourt remanded back the matter to the disciplinary authority to give atentative note of disagreement, call for representation from the petitionerand thereafter, pass fresh order after considering the same.The Courtfurther directed the petitioner to be reinstated with backwages.
2.Learned ASG submits that the petitioner was reinstated withbackwages on 6[th]April, 2016 in terms of the order dated 29[th]March, 2016.It is further submitted that the note of disagreement was issued on 5[th]May,2016 to which the petitioner has filed the response on 23[rd]May, 2016.Learned ASG further submits that the final order has been passed by thedisciplinary authority on 28[th]May, 2016. Copy of the same is served onlearned counsel for the petitioner in Court.
3.Learnedcounselforthepetitionersubmitsthatthenote ofdisagreement is not in terms of the order dated 31[st]August, 2015.Learned
counsel for the petitioner submits that full backwages have also not beenpaid to him which is disputed by learned ASG.
4.The petition is disposed of with liberty to the petitioner to availappropriate remedies available to him in respect of his grievances inaccordance with the law.
5.Copy of this order be given dasti to counsel for the parties under thesignature of the Court Master.
