By this petition filed under Section 438 read with Section 482
of Cr. P.C., the petitioner is seeking anticipatory bail in caseregistered vide FIR No.363/2015 under Section 406/506 of IPC, atPolice Station Ghazipur, Delhi.
On 16[th]October 2015, when the present bail application came
up for hearing, the petitioner was directed to join the investigation asand when required and in the meanwhile, the arrest of the petitionerwas stayed.
Sub-Inspector Mohd. Faizan Ghani, Investigating Officer ofthis case is present in Court and submits that the petitioner has joinedthe investigation and he does not need any custodial interrogation ofthe petitioner.
In view of the aforesaid, the interim protection granted to thepetitioner on 16[th]October 2015 is made absolute. It is hereby orderedthat the petitioner shall appear before the Investigating Officer of thiscase as and when called by notice in writing and in the event of arrest,the petitioner – Mohit @ Gaurav be released on bail subject tofurnishing his personal bond in the sum of Rs.15,000/- with onesurety of the like amount to the satisfaction of the InvestigatingOfficer.
Petitioner is directed not to tamper with the evidence and shallnot leave the country without prior permission of the Court.
With aforesaid directions, the present petition stands disposedof.
