Present FIR under Section 404/420/467/468/471/474/34 IPC wasregistered at Police Station Mahendra Park on the complaint of respondentNo. 2. Respondent No. 2 alleged in the FIR that his son was the tenant ofpetitioner No. 1. In the year 2012, respondent No. 2 gave `2,50,000/- to hisson to enable him to purchase house in Delhi. House bearing No. A-332was purchased by his son who unfortunately died on 30[th]May, 2012.Original papers of the property were with the deceased. Petitioners removedoriginal papers and prepared forged documents including GPA.
Petitioner and respondent No.2 have settled the matter in DelhiGovernment Mediation & Conciliation Centre, Jahangirpuri, Delhi on 12[th]
April, 2016. Respondent No. 2 submits that possession of Janta DDA flatNo. A-332, ground floor, Jahangirpuri, Delhi has been handed over by thepetitioners to him besides `80,000/- in cash, in terms of the settlement,therefore, he does not wish to pursue the FIR any further.
During the course of hearing it has been pointed out that originalchain of documents in respect of Janta DDA flat No. A-332, ground floor,Jahangirpuri, Delhi are with the Investigating Officer SI Devender Kumar ofPolice Station Mahendra Park. Investigating Officer submits that originalpapers will be handed over to the respondent No. 2 after retainingphotocopies thereof. Let it be done within week.
In view of the settlement arrived at between the parties, FIR No.372/2015, under Sections 404/420/467/468/471/474/34 IPC registered atPolice Station Mahendra Park and the consequent proceedings emanatingtherefrom are quashed subject to, however, each of the petitioners depositing`10,000/- with the Delhi High Court Legal Services Committee within fourweeks. Copy of the receipts be handed over to the Investigating Officer.
Petition is disposed of in the above terms.
