BAIL APPLN.323/2016

The present is an application under Section 439 of the Code of Criminal Procedure, 1973 (Cr.P.C.) praying for extension of interim bail granted to applicant on medical grounds.

It is an admitted position that the applicant is currently hospitalized in Eden Hospital Private Limited, East of Kailash, New Delhi.

The health condition of the applicant is stated to be critical as he suffers from epilepsy, fatty liver and stone in the kidney. Further, the applicant has suffered various epileptic strokes in hospital, as consequence of which on one occasion he has suffered fall, which has resulted in fracture in his leg and on another occasion he has suffered injuries to his backbone and head. The applicant is also stated to have contracted chickungunya, which has debilitated him further. This Court has from time to time, since July, 2015, released the applicant on interim bail.

By way of order dated 14.01.2016, in Bail Application No.78/2016, this Court was pleased to further extend the interim bail granted to the applicant for period of one month.

In view of the foregoing, it is considered just, necessary and expedient to extend the interim bail granted to the applicant on the same terms and conditions as imposed by this Court by way of order dated 06.07.2015, passed in Bail Application No.1240/2015, for further period of one month from today.

With the above directions, the present application is allowed and disposed of accordingly.
