This is an application under Section 439 Cr.P.C. filed on behalf of thepetitioner seeking grant of interim bail in case FIR No.1635/2016, underSections 394/397/342/452/120-B/201/506/411/34 IPC read with Section 27Arms Act, registered at Police Station-Mehrauli, Delhi.

Learned counsel for the petitioner submits that the son of thepetitioner has to be admitted in class 12[th]and there is nobody alive in hisfamily to make arrangement for the same. He further submits that thepetitioner has to arrange money and search school for his son and prays thatthe petitioner be granted interim bail for period of one month.

Status report has been filed on behalf of the State. Learned APP forState on instructions from the Investigating Officer submits that the son ofthe petitioner was studying in 12[th]class; however, on 01.05.2017 schoolleaving certificate was issued to him as he could not pay the fees. LearnedAPP has further submitted that the factum of death of wife of the petitionerhas been verified.

Since the petitioner is seeking interim bail at this juncture for makingarrangement of his son’s admission in school, I deem it appropriate torelease the petitioner on interim bail for period of one month effectivefrom the date of his release, on his furnishing bail bond in the sum ofRs.20,000/- with one surety of the like amount to the satisfaction of theconcerned Court below with the condition that he shall not influence theprosecution witnesses; he shall not contact, threaten or coerce the victim orany of his/her family members or to indulge in any illegal activities; he shallnot tamper the prosecution evidence, he should not leave India without priorpermission of the Court below and he should surrender before the concernedCourt below after the expiry of 30 days.

The present bail application is disposed of accordingly.
