It is brought to my notice that Judgment Debtor has filed an appeal being FAO(OS)(COMM) No.164/2017 challenging the dismissal of the objection against the Arbitral Award. In the said appeal, the Division Bench has directed the Judgment Debtor to deposit certain amounts. As the decision in the appeal would have bearing on the decree itself, learned counsel for the Decree Holder seeks leave to withdraw the present execution petition with liberty to file afresh in case need so arises.
The petition is dismissed as withdrawn with liberty as prayed.
