The learned counsel appearing on behalf of the respondent submits that thelegal notice/representation sent by the counsel for the petitioner on 15.02.2017, acopy of which is to be found on pages 95 – 100, is under the consideration of theappropriate authority dealing with the subject tender. He also has instructions tostate that unless and until the said legal notice/representation is disposed of by aspeaking order, the financial bid in the subject tender shall not be opened. He alsostates that the decision on the said legal notice/representation shall becommunicated to the petitioner immediately upon it being taken.
In view of the above statements, the learned counsel for the petitioner doesnot press this writ petition any further. However, he seeks to reserve his liberty tofile fresh petition in case the decision goes against the petitioner.
The writ petition stands dismissed as withdrawn in the aforesaid
circumstances with the liberty as prayed for.
