Respondent no.2 is present in Court along with her counsel and hasbeen identified by SI Prabhakaran of police station Chhawla. She submitsthat she has settled the matter with the petitioner no.1 of her own free willand without any undue force, pressure or coercion. She further submits thather marriage with petitioner no.1 has already been dissolved by decree ofdivorce by mutual consent passed by the Family Court, South West District,Dwarka Courts, New Delhi on 1[st]April, 2017. Petitioner no.1 has paid `3.5lacs to the respondent no.2 through demand draft, photocopy whereof hasbeen placed on record.Respondent no.2 submits that with this paymententire settled amount of `10.5 lacs stand paid and she has no objection incase FIR No.230/2015 under section 498A/406/34 IPC registered at policestation Chhawla, is quashed qua the petitioner no.1 and his relatives, that is,petitioner nos. 2 to 6.
Keeping in mind the settlement arrived at between the parties and thatmarriage between the petitioner no. 1 and respondent no. 2 has already beendissolved, no fruitful purpose would be served to keep the criminalproceedings pending.Accordingly, FIR No.230/2015 under section498A/406/34 IPC registered at police station Chhawla, and the consequentproceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Dasti.
