Initially,FIRwasregisteredunderSections397/394/34IPC.Subsequently, FIR has been converted under Sections 395/120-B/34/412IPC. Investigation is complete. Charges have already been framed and trialis underway.Out of 34 witnesses, 26 witnesses have already beenexamined. Petitioner is in custody for the last 3½ years.
Learned APP submits that petitioner had conspired with co-accusedpersons and had passed on the information about the movement ofcomplainant along with the jewellery, pursuant thereof dacoity wascommitted by the co-accused.One diamond weighing 2.540 grams was
recovered from the petitioner. Petitioner is also involved in similar casebeing FIR No. 272/2014 under Sections 392/397/34 IPC registered at PoliceStation Maurya Enclave.
Learned counsel for the petitioner submits that petitioner has not beenidentified by the complainant in Court.
Keeping in mind the totality of the facts and circumstances of thiscase, petitioner is admitted to bail, subject to his furnishing personal bondin the sum of `10,000/- (Rupees Ten Thousand Only) with one surety in thelike amount to the satisfaction of the trial court.
Bail application is disposed of in the above terms. Dasti.
