He submits that matter has been settled between thepetitionersandrespondentno.2amicablyvideMemorandumofUnderstanding Dated 10[th]October, 2005.He further submits that settledamount of `25 lacs has already been received by the respondent no.2. NOCissued by the respondent no.2 has been placed on record at pages 36 to 38.Respondent no.2 further submits that respondent no.2 has no objection incase FIR is quashed.

Keeping in mind the settlement arrived at between the petitioners andrespondent no.2 and that settled amount stands paid, in my view, no fruitfulpurpose would be served in keeping the criminal proceedings pending whichrelates to loan transaction. Accordingly, in the interest of justice, FIRNo.73/2005 under Sections 420/120-B IPC registered at police stationConnaught Place and the consequent charge emanating therefrom arequashed.

Petition is disposed of in the above terms.
