1.Counsels for the parties state that the issues which are subject matterof the present writ petition were also the issues in the case of A.K.Dewan(Capt.) Vs. Union of India & Anr. 221(2015) DLT 133, and therefore, thiswrit petition also will stand dismissed by adopting the discussion and ratioof the judgment in the case of A.K.Dewan (supra).Also, I may note thatthe judgment in the case of A.K.Dewan (supra) has been challenged beforethe Division Bench of this Court in an LPA and which is stated to bepending.

2.In any case, since the issue is covered matter against the petitioner,

in view of the judgment in the case of A.K.Dewan (supra), accordingly thiswrit petition will stand dismissed by mutatis mutandis applying thediscussion and ratio of the judgment in the case of A.K.Dewan (supra).
