This is petition under Section 482 Cr.P.C. moved on behalf of thepetitioners for quashing of FIR No.165/2015, under Sections 308/34 IPC,registered at P.S. Jyoti Nagar, Delhi and all subsequent proceedings arisingtherefrom.
Learned counsel for the petitioners submits that the petitioners andrespondent No.2 are residing in the nearby locality but due to themisunderstanding arisen between the parties, quarrel had taken placebetween them, which resulted into registration of the aforementioned FIR.He further submits that after the registration of the FIR, the near relativesand close friends intervened and the matter has been amicably settledbetween the parties and the misunderstanding has been sorted out, which hasbeen reduced down into writing vide Compromise Deed dated 05.10.2016.He also submits that nothing further remains to be adjudicated, however, the
present FIR is coming as hurdle in the peaceful life of the present petitionersand prays that the FIR in question and all proceedings arising therefrom maybe quashed.
The respondent No.2/complainant is present in Court today and hasbeen identified by the Investigating Officer, SI Shikshit Kumar. Thecomplainant admits that the matter has been amicably settled with thepetitioner and the misunderstanding has been sorted out and the saidsettlement arrived at with the petitioner is voluntary and without any force,pressure or coercion and nothing remains to be adjudicated further betweenthem and he has no objection, if the FIR in question is quashed.
Looking into the above facts and circumstances of the case since thedispute has been amicably resolved and the misunderstanding has beensorted out and nothing further remains to be adjudicated between them, tohave peace in the life of the parties and better relations in near future and tomeet the ends of justice, I deem it appropriate to quash the aforesaid FIR andall subsequent proceedings arising out of the same.
Consequently,FIRNo.165/2015,underSections308/34IPC,registered at P.S. Jyoti Nagar, Delhi and all subsequent proceedings arisingtherefrom are hereby quashed.
Parties are bound by terms of settlement dated 05.10.2016.
The present petition is disposed of accordingly.
