This is petition under Section 482 Cr.P.C. for quashing of FIRNo.312/2017, under Sections 308/506/34 IPC, registered at Police Station-Seemapuri, Delhi and all proceedings emanating therefrom.
Counselforthe petitioners has submitted that due to somemisunderstanding quarrel had taken place between the petitioners and therespondent No.2/complainant, resultantly, the complainant lodged FIRNo.312/2017, under Sections 308/506/34 IPC at Police Station-Seemapuri,Delhi. He has further submitted that after registration of the FIR qua againstthe petitioners, the relatives and the friends intervened and the matter hasbeen settled between the parties vide compromise cum settlement deed dated
22.09.2017. Learned counsel for the petitioners further submits that alldisputes have been amicably settled between the parties and nothing remainsto be adjudicated upon further and submits that the FIR in question iscoming as hurdle in the way of the present petitioners. He further submitsthat the petitioners and the respondent No.2 want to lead peaceful life innear future and since all disputes have been settled between them, the FIR inquestion and all proceedings arising therefrom may be quashed.
The respondent No.2/complainant Mr.Ram Niwas is present in Courttoday and has been identified by the Investigating Officer SI ManishChaudhary. The respondent No.2/complainant also admits that the matterhas been amicably settled with the petitioners and he has no claim orgrievanceleftagainstthepetitioners.Hefurthersubmitsthatthesettlement/compromise has taken place voluntarily, without any force,pressure or coercion. He further submits that he has no objection if the FIRin question is quashed.Looking into the above facts and circumstances, since the matter hasbeen amicably settled between the parties and nothing remains to beadjudicated further, to have peace in the life of the parties, I deem itappropriate to quash the FIR No.312/2017, under Sections 308/506/34 IPC,registered at Police Station-Seemapuri, Delhi, and all proceedings emanatingtherefrom.
The present petition is allowed and disposed of accordingly.Copy of the order be given dasti.
