1.This writ petition seeking writ effectively of quo warrantodoes not lie in the absence of pleading of violation of statutory provisionin view of the ratios of various judgments of the Supreme Court includingthe judgments in the cases of B. Srinivasa Reddy vs. Karnataka UrbanWater Supply and Drainage Board Employees' Association and Ors. (2006) 11SCC 731 and Rajesh Awasthi vs. Nand Lal Jaiswal and Ors. (2013 )1SCC 501, and therefore, this writ petition is prayed to be withdrawn withliberty to the petitioner to file appropriate independent proceedings to seekthe relief of declaration.
