SH ANIS..... PetitionerThroughMr. Vijay Waghey and Mr. Kushager,Advs.

versus

EAST DELHI MUNICIPAL CORPORATION AND ORS.

..... RespondentsThroughMr. G.D. Mishra, Standing Counselfor EDMC/R-1.

CORAM:

HON'BLE MR. JUSTICE A. K. CHAWLAO R R%02.11.2017

Petitioner has approached this Court alleging unauthorizedconstructions in as many as 19 properties falling within thejurisdiction of EDMC.During the course of hearing, an anxietydeveloped as to the cause arising to the petitioner to file the instantpetition. On being queried, ld. counsel for the petitioner submits thatthe petitioner is not social worker, but, property dealer. Is it thatthe instant petitioner could see only 19 unauthorized constructionsgetting raised in East Delhi? Ld. counsel for the petitioner is unableto explain. One can take judicial note of the fact that unauthorizedconstructions are getting raised unabatedly.Strong nexus amongstthe builders, officials of municipalities, police and others seems to beprevailing over. Be that as it may, person, alike the petitioner, who

at random has chosen to approach this Court with some specificproperties, cannot be allowed to misuse the process of the Court. Asfortheprevailingstrongnexusofthebuilders/officialsofmunicipalities, police and others, another bunch of petitions is comingup before this Court today only and therefore, it is not considerednecessary to pass further directions in the instant matter. In viewthereof, the petition is dismissed. It is however, expected of therespondent-EDMC to look into the contents of the instant petition andtake the necessary actions as expeditiously as possible, as providedfor under law.
