On the complaint of respondent No. 2, FIR No. 205/15 under Sections279/337 IPC was registered at Police Station Sun Light Colony.It issubmitted that offence under Section 337 IPC was converted to offenceunder Section 338 IPC in view of the medical report.
It is further submitted that petitioner and respondent no. 2 have settledtheir disputes amicably and pursuant thereof offence under Section 338 hasbeen permitted to be compounded by the Metropolitan Magistrate-07, SouthEast District, Delhi vide order dated 27.07.2016 (Annexure P-3). It is prayedthat offence under Section 279 may be quashed.
Respondent no. 2 is present in Court and has been identified by SIRam Kishan of Police Station Sun Light Colony. Respondent no. 2 admitshaving settled the matter with the petitioner of his own free will and withoutany undue force, pressure or coercion and he has no objection in case FIR isquashed for the offence under Section 279 IPC.
Keeping in view the settlement arrived at between the petitioner and
respondent no. 2 before the Mediation Centre, in the interest of justice,aforesaid FIR for the offence under Section 279 IPC registered at PoliceStation Sun Light Colony and the consequent proceedings emanatingtherefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous applicationsstand disposed of as infructuous. Dasti.
