This is petition under Section 482 Cr.P.C. moved on behalf of thepetitioner for quashing of FIR No.250/2011, under Sections 457/380/506/34IPC, registered at P.S. Delhi Cantt. and all subsequent proceedings arisingtherefrom.
Learned counsel for the petitioner submits that the dispute which hasarisen is due to the matrimonial discord between the parties, which resultedinto registration of the aforesaid FIR. He further submits that the petitioner
is the widowed daughter in law of respondent No.2. He further submits thatafter the registration of the FIR, the near relatives and close friendsintervened and the matter has been amicably settled between the partiesbefore the Mediation Centre, Dwarka Courts vide Settlement dated30.11.2016. He further submits that the keys of the property i.e. 1/73, 2[nd]Floor, Sadar Bazar, Delhi Cantt., New Delhi has already been handed overto the respondent No.2. He also submits that the misunderstanding has beensorted out and nothing further remains to be adjudicated, however, thepresent FIR is coming as hurdle in the peaceful life of the present petitionerand prays that the FIR in question and all proceedings arising therefrom maybe quashed.
The respondent No.2/complainant is present in Court today and hasbeen identified by the Investigating Officer, Inspector Suresh Kaushik. Thecomplainant admits that the matter has been amicably settled with thepetitioner and the misunderstanding has been sorted out and the saidsettlement arrived at with the petitioner is voluntary and without any force,pressure or coercion. He also submits that the keys of the said property havealready been handed over to him. He also submits that nothing remains to beadjudicated further between them and that he has no objection, if the FIR inquestion is quashed.
Looking into the above facts and circumstances of the case since thedispute has been amicably resolved amicably and the misunderstanding hasbeen sorted out and nothing further remains to be adjudicated between them,and to meet the ends of justice, I deem it appropriate to quash the aforesaidFIR and all subsequent proceedings arising out of the same.
IPC, registered at P.S. Delhi Cantt. and all subsequent proceedings arisingtherefrom are hereby quashed.
The present petition is disposed of accordingly.
