Petitioner claims that her maternal grandmother (Naani) is being illegally detained by respondents No.3 to 6 being her son, daughter-in-law and grandchildren. The petitioner is citizen of United States of America. She claims that when she visited her Naani, she was not allowed to meet her, she was abused and manhandled, forcing her to make police complaint. By the present writ petition she seeks production of Smt.Vimla Chopra (maternal grandmother of the petitioner) and also seeks direction to respondents No.2 to 6 to allow her to her Naani.

On advance copy being served respondent No.3 is present in Court. He submits that his mother, i.e. the maternal grandmother of the petitioner, is on her last stage. She is suffering from Dementia and other diseases. The latest prescription dated 02.01.2017 has been produced in Court as per which it is stated that the patient is disoriented and disillusioned, she is advised complete physical and mental rest. The prescription dated 03.01.2017 also mentions that the patient is disoriented and not responding to commands. He further submits

that post 03.02.2017, condition of her mother has further deteriorated. He further submits that he has no objection to the petitioner meeting her maternal grandmother provided she can maintain congenial behaviour. We are informed that the petitioner has to return to USA on 14.02.2017.

It is agreed that the petitioner would be permitted to meet her maternal grandmother in the presence of lady constable in plain clothes for 30 minutes at 11:00 AM on 05.02.2017 (Sunday) and 12.02.2017 (Sunday). Ordered accordingly.

With the above directions the petition stands disposed of.
