The petitioner has invoked the writ jurisdiction of this Court under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 for issuance of writ of certiorari thereby quashing the Look Out Circular (LOC) issued against him and also writ of mandamus directing the trial court to return the passport.
Learned counsel for the petitioner at this stage submits that he does not press the prayer (b) of the petition for return of the passport with liberty to move the trial court. In the status report, it is mentioned that investigation has already been completed in all respects and charge-sheet has been filed before the trial court and petitioner is not more required in the present case.
It is also submitted that no LOC has ever been issued by the respondent/State. Therefore, the petition has become infructuous. Disposed of with liberty to the petitioner to move the trial court as prayed.
