Crl.M.A.13286/2017 (modification of order) in W.P.(CRL) 1247/2017

The petitioner has sought modification of the order dated 23.05.2017passed by this court whereby the petitioner was released on furlough.

The petitioner, according to the order, was directed to furnish bondin the sum of Rs.10,000/- with one surety of the like amount to thesatisfaction of the Superintendent of the concerned jail for being released onfurlough. It has been submitted that because of the long incarceration of thepetitioner and his poverty, he is not in position to arrange for surety in thesum of Rs.10,000/-. He, therefore, prayed that he may be allowed to furnishhis bond and the cash surety of Rs.10,000/-.

For the reasons stated in the application, the prayer is allowed. Theorder dated 23.05.2017 passed in W.P.(CRL) 1247/2017 is modified to the

extent that the petitioner be released on furlough on his furnishing personalbond with cash surety in the sum of Rs.10,000/- to the satisfaction of theSuperintendent of the concerned jail.The other conditions which wereimposed upon the petitioner in the order dated 23.05.2017 shall continue tosubsist.

The application seeking modification is allowed accordingly.
