In this disposed of appeal, by way of this application, appellants No.1 & 3 inform that appellant No. 2 had died on 31[st] January, 2017 and copy of death certificate is filed alongwith this application. copy of two fixed deposit receipts in the sum of Rs.20,856.20 each in the name of appellant No.2 has been filed along with this application.
Notice.
Mr. Shoumik Mazumdar, Advocate accepts notice on behalf of respondent No.3-Insurer and submits that there is no objection to release of share of appellant No.2 in favour of first appellant.
Upon hearing, application is allowed and direction is issued to the Delhi High Court Branch of UCO Bank to release share of appellant No.2 in favour of first appellant in respect of these two FDRs in question.
With aforesaid directions, this application is disposed of.
