Notice.Learned ASC accepts notice for respondent no. 1.
Respondent no.2 Ms. Soniya is present in Court along with her counsel andaccepts notice.She has been identified by SI Parmod Kumar of policestation Sangam Vihar.
Respondent no.2 submits that she has settled the matter with thepetitioner no. 1 of her own free will and without any undue force, pressureor coercion before the Mediation Centre, Saket Courts, New Delhi on 20[th]November, 2017.Respondent no. 2 submits that her marriage with
petitioner no.1 has already been dissolved by decree of divorce by mutualconsent dated 13[th]April, 2018 passed by the Family Courts, South District,Saket Courts, New Delhi.Petitioner no. 1 has paid `2,00,000/- to therespondent no. 2, vide demand draft, photocopy whereof has been placedon record. Respondent no. 2 says that entire settled amount of `10,00,000/-stands paid with this payment and she has no objection in case FIR isquashed against the petitioner no. 1 and his relatives, that is, petitioner nos. 2to 4.Affidavit of respondent no. 2 to this effect is also on record at pages19-20.
Keeping in mind the settlement arrived at between the petitioner andrespondent no. 2 voluntarily, in my view, no fruitful purpose would beserved to keep the criminal proceedings pending.Accordingly, in theinterest of justice, FIR no. 218/2017 under Sections 498-A/406/34 IPCregistered at Police Station Sangam Vihar and the consequent proceedingsemanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous applicationis disposed of as infructuous. Dasti.
