1.By thispetition,thepetitionerseeksquashingofFIRNo.35/2015 under Sections 406/498A/34 IPC, Police Station BharatNagar.
2.ThesubjectFIRemanatesoutofmatrimonialdiscord.Petitioner is the husband of respondent No.2.
3.Parties have settled their dispute and compromise has beenarrived at between the parties.
4.Respondent No.2 is present in person, is represented by counseland identified by the Investigating Officer. She confirms that thesettlement has taken place and further the marriage between theparties has been dissolved by way of decree of divorce on 09.02.2015.
5.In view of the above and keeping in view of the fact that theFIR emanates from matrimonial discord and the parties have resolvedtheir dispute and compromise has been arrived at between theparties and further respondent No. 2 does not wish to press hercomplaint, continuation of criminal proceedings will be an exercisein futility and justice in the case demands that the dispute between theparties is put to an end and peace is restored; securing the ends ofjustice being the ultimate guiding factor. It would be expedient toquash the subject FIR and the consequent proceedings emanatingtherefrom.
6.Accordingly, FIR No.35/2015 under Sections 406/498A/34IPC, Police Station Bharat Nagar and the consequent proceedingsemanating therefrom are hereby quashed.
7.Order Dasti under signatures of Court Master.
