..... Respondent

Through Mr. M.U. Khan, Adv.

CORAM:

HON'BLE MR. JUSTICE RAJIV SHAKDHER

I.A. No.16690/2018

1 Allowed, subject to just exemption.

O.M.P.(MISC.)(COMM.) 374/2018

2 Issue notice. Mr. M.U. Khan accepts notice on behalf of the

respondent.

3 Learned counsel for the respondent says that he does not wish to file reply as he does not oppose the prayer made in the petition.

4 The record shows that the Presiding Arbitrator received his request for appointment to the Arbitral Tribunal on 12.06.2017. It appears that the first hearing was held by the Arbitral Tribunal on 12.07.2017.

5 Furthermore, I am informed that the parties had agreed for extension of tenure of the Arbitral Tribunal beyond the statutory period of 12 months by agreeing to grant of extension by another six months.

6 Consequently, I am told that since the extended period is coming to an end on 12.12.2018, further extension would be required as the arbitral proceedings are at the stage of final arguments.

7 Having regard to the aforesaid circumstances, as prayed, further six months are granted for conclusion of arbitration proceedings, commencing from 12.12.2018.

8 Petition is disposed of in the aforesaid terms.
