CORAM:HON'BLE MR. JUSTICE A.K. PATHAK
O R R%25.05.2018
It is submitted that petitioners and respondent nos. 2 to 5 are
neighbours.A quarrel took place between them on some trivial issues,whichledtoregistrationofFIRno.454/2015underSections452/323/506/34 IPC at police station Timarpur on the complaint ofrespondent no. 2. With the interventions of their common friends and otherfamily members, petitioners and respondent nos. 2 to 5 have settled theirdisputes amicably, vide Compromise Deed dated 12[th]March, 2018;therefore, aforesaid FIR and the consequent proceedings emanatingtherefrom may be quashed. Respondent nos. 2 to 5 are present in Court and
have been identified by SI Neeraj of police station Timarpur. Respondentnos. 2 to 5 admit having settled the matter with petitioners of their own freewill, voluntarily and without any undue force, pressure or coercion and theyhave no objection in case aforesaid FIR is quashed. Affidavits of respondentnos. 2 to 5 are also on record.
Keeping in mind the settlement arrived at between the petitioners and
respondent nos. 2 to 5 voluntarily, in my view, no fruitful purpose would beserved to keep the criminal proceedings pending.Accordingly, in theinterest of justice, FIR no. 454/2015 under Sections 452/323/506/34 IPC atpolicestationTimarpurandtheconsequentproceedingsemanatingtherefrom are quashed.
