1.The petitioners,in CRL.M.C.2417/2018seek quashingof FIR No.765 of2015 underSections308/34ofthe IPC PoliceStationAdarshNagar,New Delhi and Petitionersin CRL.M.C.2430/2018seek quashingofFIRNo. 762 of 2015 under Sections 323/325/34of the IPC, Police StationAdarsh Nagar, New Delhi, based on settlement.SubsequentlySection308 of the IPC has been added.

2.The subjectFIRs are crossFIRs whichwereregisteredconsequenttoa quarrelwhichtookplacebetweentheparties.

3.The partiesare friends,neighboursand also relatedto each other. Itis contendedthat the quarrelhappenedon the spur ofmoment on accountof some misunderstanding.They have since settled their disputes. Thememorandumof understandingdated 23.04.2018has been executedwiththe interventionoffriendsand family.

4.Boththe partiesare presentin personin Courttoday,representedbytheir counselsand are identifiedby the InvestigatingOfficer.They submitthat they have settledtheir all disputeswith the interventionoflocals andrespectablepeople of the locality. They further submit that they do notwish tothe criminaleachother further. presscomplaintsagainstany

5.In view of the fact that the disputes between the parties has beensettled,continuationof criminalproceedingswill be an exercisein futilityandjusticein the case demandsthatthe disputebetweenthepartiesis puttoan end and peaceis restored;securingthe ends ofjusticebeingthe ultimateguidingfactor.It wouldalso be expedientto quashthe subjectFIRs and theconsequentproceedingsemanating therefrom.

6.In view of the above, the petitions are allowed. FIR No. 765 of

2015 underSections308/34ofthe IPG PoliceStationAdarshNagar, NewDelhi and Petitionersin GRL.M.G. 2430/2018seek quashingof FIR No.762 of 2015 under Sections 323/325/34 of the IPG and subsequentlySection308 ofthe IPG has been added,PoliceStationAdarshNagar,NewDelhi and the consequent proceedings emanating therefrom are,accordinglyquashed,subjectto the each ofthe petitionersdepositingcostofRs.5,000/-each to be paid to the DelhiHigh CourtAdvocatesWelfare,Trustwithintwo weeks.The receiptofdepositofthe costs imposedby thisOrder be furnishedto the concernedInvestigatingOfficerwithinaperiodof threeweeksfrom today.
