Petitioner was suspended on 11.09.2015 and charge sheet was filed on 13.12.2016. The grievance made in this petition that the enquiry has not yet been concluded and the subsistence allowance has not been revised to 75%. Learned counsel for petitioner submits that the evidence has been recorded by Inquiry Officer and he has to furnish his report to the disciplinary authority. He further submits that the suspension has to be reviewed after every six months but it has not been done and that petitioner had made numerous Representations in this regard and the last Representation made by petitioner is of 16.02.2018 Annexure P-8 (colly). It is submitted that there is no response to the aforesaid Representation.

Despite service of the advance notice upon the respondents, there is no appearance on their behalf.

In the facts and circumstances of this case, it is deemed appropriate to dispose of this writ petition with direction to the first respondent to effectively consider petitioner’s Representation of 16.02.2018 and to pass speaking order thereon within period of four weeks and its fate be conveyed to petitioner within period of two weeks thereafter, so that petitioner may avail of the remedy as available in law.

With the aforesaid direction, this petition and the applications are disposed of.

Copy of this order be given dasti to counsel for petitioner.
