1.The petitioner by this petition had impugned the interim order datedof the appellate court. Learned counsel for the petitioner submits that theCourt had finally disposed of the petition vide judgment dated 22.01.2018and the present petition has become infructuous. Copy of the judgmentdated 22.01.2018, has been produced and taken on record.
2.Since the petitioner had succeeded before the appellate court, theamount of Rs. 10 lakhs deposited by the respondent in terms of order dated12.12.2017, be released to the petitioner along with accrued interest, if any,thereon. The respondent shall get due credit for the said amount before thetrial court.
3.In view of the above, learned counsel for the petitioner seeks leaveto withdraw the petition.to withdraw the petition.
4.The petition is accordingly dismissed as withdrawn.
