Vide Office Order of 27[th] March, 2018 (Annexure P-1) provisional pension has been sanctioned in favour of petitioner. Not satisfied with the quantum of provisional pension, Representations followed by legal notice of 22[nd] March, 2018 (Annexure P-6) was served by petitioner upon first respondent. According to petitioner’s counsel, there is no response to the Representation/legal notice.

Despite service of advance notice, there is no Representation on behalf of the respondents.

In the facts and circumstances of this case, it is deemed appropriate to dispose of this petition with direction to first respondent to consider the legal notice/(Annexure P-6) as Representation and to give speaking response to it, within period of six weeks and the fate of said legal

notice/Representation be made known to petitioner within week thereafter, so that petitioner may avail of the remedies, as available in law, if need be.

First respondent be apprised of this order forthwith, to ensure its compliance.

With the aforesaid directions, this petition is disposed of.

Copy of this order be given dasti to petitioner’s counsel.
