Notice.Learned APPaccepts noticeforrespondent no. 1.Respondent no. 2 Mr. Aasim Naqvi is present in Court and accepts notice.He has been identified by SI Rishi Sharma of police station Jamia Nagar.
Respondent no.2 submits that he has settled the matter with thepetitioners of his own free will and without any undue force, pressure orcoercion, vide Agreement-cum-Memorandum of Understanding dated 2[nd]October, 2018. Respondent no. 2 says that he has no objection in case FIRNo. 365/2017 under Sections 420/406/468/471/34 IPC registered at PoliceStation Jamia Nagar, which is at the investigation stage, is quashed.
Keeping in mind the settlement arrived at between the petitioners and
respondent no. 2 voluntarily, in my view, no fruitful purpose would beserved to keep the criminal proceedings pending.Accordingly, in theinterest of justice, aforesaid FIR, which is at the investigation stage, isquashed.
Petition is disposed of in the above terms. Miscellaneous applicationis disposed of as infructuous. Dasti.
