1. This is petition filed under Section 14 of the Arbitration and Conciliation Act, 1996.
2. Briefly, the prayer made in the petition is to terminate the mandate of Mr. K.K. Peshin, who was appointed as the sole arbitrator by the respondent and instead, to appoint another independent and impartial arbitrator.
3. Mr. Ramesh Singh, who, appears for the respondent, had taken time to obtain instructions.
4. It appears that the parties are agreed on the name of Mr. S.C. Vasudeva, Additional Director General (Retd.), Civil Public Works Department, to act as sole arbitrator in place of Mr. K.K. Peshin.

5. Accordingly, prayer made in the petition is allowed.
6. Mr. S.C. Vasudeva, Additional Director General (Retd.), Civil Public Works Department is appointed as the sole Arbitrator, in place of Mr. K.K. Peshin.
7. As agreed by both the parties, learned Arbitrator will be paid consolidated fee of Rs.5 lakhs which will be equally shared by the parties.
8. Needless to say, before commencing with the arbitration proceedings, the learned Arbitrator will make the requisite declaration under Section 12 of the Arbitration and Conciliation Act, 1996.
9. In view of the order passed above, I.A. No.No.9384/2018 shall stand closed.
