The nominal roll of the petitioner reflects that as on 08.03.2018 he has been in custody for 3 years, 6 months and 26 days. The charges against him had been framed under Section 395 r/w Section 120B of the IPC. Learned counsel for the petitioner points out there is no evidence which is forthcoming against the petitioner. It is stated that the 10 witnesses who have been examined have not spoken against anything him. The status report has been filed by the State. It is taken on record. Learned counsel for the State fairly concedes that the role against the petitioner may not be stark but his role as co-conspirator is prima facie evident and that is why charge under Section 120B of the IPC has been framed against him. As per the version of the State, it was on the disclosure statement of the co-accused that the motor bike of the petitioner had been recovered.

Trial is yet going to take time.

Petitioner be admitted to bail on furnishing of his personal bond in the sum of Rs 10,000/- with one surety of the like amount to the satisfaction of the concerned trial court with condition that he shall appear before the trial Court as and when the matter is taken up for hearing unless specifically exempted; he shall also furnish his latest residential address and mobile number to the concerned investigating officer.

Petition is disposed of in the above terms.
