PW-3 Ajit Kumar, brother of the deceased has confirmed hisstatement under Section 161 Cr.P.C. during the trial. His testimony bringson record, prima facie, oral dying declaration of the deceased, inter alia, asto the involvement of the applicant in the offence of murder.
At this stage of the proceedings, it cannot be said that the chargesagainst the applicant are wholly unfounded.
The bail application and the accompanying application are dismissed.
