The dispute in the present petition is that the petitioner’s eatery hasbeen sealed by the respondent on the ground that it was functioning in un-sanitary and unhygienic conditions.

Counsel appearing for the petitioners states that petitioner No. 1 now

has Health Trade License dated 16.11.2018, which would entitle him torun his eatery.

Learned counsel appearing for the respondent submits that if on thebasis of the Health Trade License now available, the petitioners were toapply to the Deputy Commissioner (City Shahdara-Paharganj Zone) of theNorth Delhi Municipal Corporation, the Deputy Commissioner wouldconsider such application in accordance with law.

Counsel for the petitioners submits that on the basis of the statement

made by the respondent, the petition may be disposed of, putting therespondent to timeline within which to process the petitioner’s applicationfor de-sealing.

Accordingly, the present petition is disposed of with the direction thatthe respondent shall consider and dispose of the petitioner’s application forde-sealing of his premises within two weeks of his making such applicationto the concerned officer as mentioned in this order.

The present petition and application are disposed of in the aboveterms.
