This petition seeks quashing of FIR No. 307/2013. The petitioners are police personnel and have been accused of extorting money from the complainant. The lis is stated to have been settled at Rs.10 lacs. All monies have been paid to the complainant. However, the case raises an alarming issue of police personnel being involved in committing extortion apropos civilians. They are alleged to have sold property to an unsuspecting civilian.
Ms. Nandita Rao, the learned counsel for the State submits
that Departmental Proceedings were initiated against the petitioners namely, Kamlesh and Rajbir and they have been awarded punishment of forfeiture of three years approved service permanently and are also the entailing proportionate reduction in their pay with immediate effect.
The aforesaid punishment is departmental i.e. an internal
matter of Delhi Police. However, the criminality of the allegations
as may be, is required to be looked into.
There is no occasion to quash the FIR. Accordingly, the petition is dismissed.
