O R R% 29.03.2019

Issue notice to the respondent.

Ms. Harpreet Singh, Senior Standing Counsel accepts notice on behalf of the respondent.

The petitioner is aggrieved by the fact that despite its effort to export the goods in 2018 and the subsequent adjudication which resulted in the confiscation of goods, the respondent has not yet acted and issued the detention certificate and also not released the goods. It is highlighted that the redemption fine (Rs.3 lakhs) has been deposited in protest, and an appeal has been preferred to the Commissioner

(Appeals).

The Revenue does not dispute the position emerging from the petitioner’s averments; accordingly the custom authorities are hereby directed to take appropriate steps and issue the detention certificate and at the same time release the goods within two weeks.

This writ petition is disposed of in the above terms.
