In the above captioned two petitions quashing of complaints Nos. 162/1/09 & 69/1/13 and summoning order of 31[st] July, 2013 are sought on behalf of petitioner.
Since these two petitions are arising out of the common order, therefore, with the consent of learned counsel for the parties, these petitions heard together and are being disposed of by this common order.
Learned counsel for petitioner submits that the matter is coming up before trial court on 23[rd] May, 2019 for hearing on the point of charge. Since petitioner has an alternate and efficacious remedy to seek discharge from trial court by urging the pleas taken herein, therefore, this Court is not inclined to exercise its inherent extra ordinary jurisdiction under Section 482 of Cr.P.C.
Accordingly these petitions and applications are disposed of, with liberty to petitioner to urge the pleas taken herein before trial court at the charge stage, while not commenting on the merits of this case.
