CM APPL. 34896/2019

Exemption allowed, subject to all just exceptions. The application stands disposed of.

W.P.(C) 8456/2019 and C.M. No. 34895/2019

Issue notice. Mr. Goyal accepts notice.

The petitioner assails the order dated 29.07.2019 passed by the Central Administrative Tribunal, Principal Bench, New Delhi (the Tribunal) in M.A. No. 2391/2019 in O.A. No. 2127/2019. The Tribunal has rejected the petitioner’s interim application (M.A. No. 2391/2019) by observing that the relief sought in the said application has been sought in the Original Application itself and that the Original Application was heard earlier on

22.07.2019. The Tribunal has not granted interim relief and directed the matter to be listed before the Registrar’s Court for completion of pleadings on 29.07.2019.

The petitioner, by way of interim relief has sought direction that he should be permitted to provisionally appear in the Skill Test which is scheduled to be held on 15.06.2019 and 31.07.2019. Admittedly, the dates of the skill test have already been elapsed. In these circumstances, we are not inclined to interfere with the impugned order at this stage.

We make it clear that the process undertaken by the respondents would be subject to orders that the Tribunal may eventually pass in the Original Application.

The petition stands disposed of in the aforesaid terms.
