1.Petitionerbythisrevisionpetitionimpugnsorderofpreliminary assessment under Section 15 of the Juvenile Justice (Careand Protection of Children) Act, 2015 dated 25.02.2017 passed by theJuvenile Justice Board.

2.Learned APP for the State as also the counsel for the childvictim object to the maintainability of the present petition and submitthat Section 101 of the Act specifically provides for an appeal againstthe order of the Board and lays down particular procedure to befollowed by the Court of Sessions Judge while deciding the appeal.

3.Learned counsel for the petitioner seeks leave to withdraw thepetition with liberty to impugn the same by way of an appeal under

Section 101 of the Act.

4.In view of the above, the petition is dismissed as withdrawnwith liberty to the petitioner as prayed for.

5.Since substantial time has been spent by the petitioner in theseproceedings, it is directed that in case any appeal is filed by thepetitioner, the Appellate Court shall consider the same expeditiouslyand preferably on day to day basis.
