Vide the present application, the petitioner/accused seeks interim bail for period of one month to attend the ‘Rasam Pagri’ which is to be held on 25.11.2019.
It is not disputed that vide order dated 18.11.2019, co-accused and brother of the petitioner herein has already been granted interim bail to attend the last rites of his mother. The petitioner, who is elder brother of the co-accused, has also prayed for interim bail to attend rasam pagri on 25.11.2019.
Learned APP appearing on behalf of the State opposes the present application by stating that the petitioner has criminal record and there are as many as 49 cases against him and if he is granted interim bail, there is every likelihood that he would flee from judicial process.
The fact remains that the co-accused, who is the brother of the petitioner, has already been enlarged on bail by the learned Addl. Sessions Judge on 18.11.2019 despite the fact that there are number of criminal cases pending against him. Therefore, on the ground of parity, I hereby grant interim bail to the petitioner from 23.11.2019 to 26.11.2019, subject to his furnishing personal bond in the sum of ₹.25,000/- with one surety of the like amount to the satisfaction of the Trial Court and further subject to the following conditions:-
a.That he shall not come in contact with or try to influence any of the witnesses connected with the case either directly or indirectly during the period of interim bail; witnesses connected with the case either directly or indirectly during the period of interim bail;
b.That he shall not directly or indirectly make any inducement, threat or promise to any person so as to dissuade him/her from disclosing the facts before the court and he shall not tamper with the evidence in any manner during the period of interim bail; promise to any person so as to dissuade him/her from disclosing the facts before the court and he shall not tamper with the evidence in any manner during the period of interim bail;
c.That he shall not leave Delhi/NCR without prior permission of the court during the period of interim bail; court during the period of interim bail;
d.That he shall mark his presence with duty officer of PS Dayalpur between 6:00 pm to 8:00 pm on daily basis during the period of his interim bail; between 6:00 pm to 8:00 pm on daily basis during the period of his interim bail;
e.That he shall not misuse the concession of interim bail granted to him;
f.That he shall not change his address without prior intimation to the court and he shall not indulge himself into any such offence during the period of his interim bail; court and he shall not indulge himself into any such offence during the period of his interim bail;
The petitioner shall surrender himself directly before the jail authority on
27.11.2019 by 5:00 p.m.
The bail application stands disposed of accordingly.
Copy of this order be sent to the Jail Superintendent concerned for necessary compliance.
