The status report in terms of order dated 29.06.2020 has been submitted by the State. It appears through the status report that the PCR calls have been made by both the petitioner and the accused persons; FIR No.35/2020, PS Chandni Mahal, under Section 160 of the Indian Penal Code, 1860 has been registered against both sides involved in the incident; preventive action vide DD No.35A dated 13.01.2020 under Sections 107/150 of the Cr.PC, 1973 was also initiated against both sides by the Executive Magistrate, Kamla Market; FIR No.177/2020 dated 16.05.2020 under Section 160 of the Indian Penal Code, 1860 is also indicated to have been registered against both sides.
The status report that has been submitted under signatures of the
SHO, PS Chandni Mahal dated 08.07.2020 indicates that in terms of proceedings dated 29.06.2020, the mobile number of the beat staff and landline number of the police station has been given to the petitioner and the
beat and division staff has been briefed about the direction of the Court.
In as much as the record indicates that petition under Section 156(3) of the Cr.PC, 1973 had been filed by the petitioner as averred in para 6 of the petition itself, which was stated to have been filed in Central District, THC, on behalf of the petitioner has been placed on record the tracking report of the case titled Zahida Begum Vs. Iqbal stated to be pending in the Court of learned CMM, Central District, THC wherein it is indicated as per the case status that the matter is now fixed for 07.08.2020 in the Court of the CMM, THC.
In the circumstances, the respondents would provide all adequate security and protection to the petitioner and her family members as and when required. It is further directed that the learned CMM, THC shall without default take up the complaint that has been filed by the petitioner titled as Zahida Begum Vs. Iqbal on the date 07.08.2020 filed vide CNR No.DLCT020064522020 & Case No.Ct. Cases/0003758/2020.
Copy of this order be sent to the learned District & Sessions Judge, (Central) to ensure the compliance of the above directions.
The petition calls for no further action and is disposed of accordingly.
