3.The present petition has been filed by the petitioner under Section 439 Cr.P.C. read with Section 482 Cr.P.C. for grant of bail in case FIR No.448/2020 registered at Moti Nagar, Delhi.
4.Notice issued.
5.Learned APP for the State accepts notice.
6.With the consent of the counsel for the parties, the present petition has
been taken up for final disposal.
7.Learned APP has opposed the present petition by stating that there are serious allegations against the petitioner and he may influence the witnesses during
trial if he is released on bail. Therefore, the present petition deserves to be dismissed.
8.It is not in dispute that the similar role assigned to the co-accused Aatur Tyagi who has been granted bail by the Co-ordinate Bench of this Court vide order dated 13.08.2020. Therefore, on parity, I am of the view that the petitioner deserves bail. 9.Accordingly, he shall be released on bail on his furnishing personal bond in the sum of Rs.25,000/- and with one surety in the like amount to the satisfaction of the Trial Court.
10.The petition is, accordingly, allowed and disposed of.
11.Copy of this order be transmitted to the Jail Superintendent concerned and Trial Court for necessary compliance. and Trial Court for necessary compliance.
12.The order be uploaded on the website forthwith.
