The present petition has been filed by petitioner for grant ofanticipatory bail in FIR No. 527/2019 dated 30.10.2019 for offencepunishable under Section 308/34 IPC registered at Police Station BharatNagar(North West), Delhi.
Pursuant to directions passed by this Court, petitioner has earlierjoined investigation and nothing is required to be recovered from him now.
Moreover, co-accused, who has been assigned similar role, hasalready been released on bail.
In addition to above, all accused are either on anticipatory bail orregular bail.
Keeping in view facts and circumstances of the case, this Court is ofthe considered view that present case is fit for anticipatory bail.
Accordingly, the SHO/ Arresting Officer/IO concerned, is herebydirected that in the event of arrest, petitioner/ applicant shall be released on
bail on the following terms and conditions:-
(i) Petitioner shall furnish personal bond in the sum of ₹25,000/- with one surety in the like amount subject to the satisfaction of ArrestingOfficer/SHO/IO concerned;
(ii) Petitioner shall cooperate with the investigation and make himselfavailable for interrogation by police officer, as and when required;
In case of default of aforementioned conditions, the State is at libertyto take appropriate recourse in accordance with law.
Before parting with the order, it is relevant to mention that nothingcontained in this order shall be construed as an expression on the merits ofthe case.
Petition stands allowed and disposed of.
Order dasti under signatures of the Court Master.
Copy of this order be transmitted to SHO/IO concerned for necessarycompliance.
